Dear all,
As indicated in previous emails, EC-OE is pleased to let you know that we obtained a positive judgment by the ’Tribunal Administratif de Lyon’ (Fr) regards the Simon Butler case (+ 6 other UK ski instructors).
The final conclusion of these judgements is that the court has overruled the refusal by the ‘préfet de la region Rhône-Alpes’ to deliver a ‘carte professionnelle’ to these 7 EU citizens in order to work as ski instructors in France.
Attached to this email please find our analysis of this ‘historic’ judgement by the ‘Tribunal Administrative de Lyon’.
FYI this attachment also includes a copy of the 7 individual judgements.
In conclusion we think it is fair to state that – contrary to popular gossip – Europe (Dir. 2013/55/EU) has really proved it’s ‘added value’, in this dossier.
Consequently, we sincerely do encourage the EU to impose it’s legislation regards the ‘Recognition of Professional Qualifications’ on the EU Member States.
We have experienced enough individual sufferings, family drama’s, bankruptcies, imprisonments, abusive judgments, …etc.
From our side we apologise and sincerely regret that it took +/- 20 years to fight French legislation and that during all those years we were not able to help hundreds, even thousands of devoted people (mostly ski instructors) to ‘survive’. Sorry.
Finally, in case the French authorities would decide to appeal this judgement, we hereby confirm that EC-OE will not hesitate to take this dossier to the European Court in Luxemburg.
